Members of our team have worked on the following projects:
 
Renewable Energy 
 

Wind

  • advised on the development and construction of a $220 million Wind Farm project comprising a wind farm exceeding 130 MW and consisting of over 60 x 2.1 megawatt wind turbine generators.
  • various acquisitions in Australia for a European wind farm developer and operator including the introduction to a large wind pipeline that was successfully developed and sold. 
Solar
  • acted for a major international solar park operator (PV) in developing and the partial sale of three off-grid solar installations in the Northern Territory.
  • acted for a major international PV solar panel producer with respect to its bid for the Solar Flagship program in a consortium with a private equity group and a major project engineering company.
  • acted for various producers, suppliers and installers of PV systems in the commercial and retail market with respect to regulatory, contractual and financial issues. 
Biodiesel and Biomass
  • acted for the joint venture owners on major contracts for a $80 million biodiesel plant with dedicated tank farm facilities.
  • acted for the developers of two biomass power stations involving the design, construction and financing. 

Social Infrastructure

  • acted for leading specialist student accommodation providers in relation to the finance, design, construction, operation and maintenance of new university student accommodation in Western Australia.
  • acted for a major investment bank on the establishment of a Social Infrastructure Fund to acquire a number of social PPP / infrastructure assets including schools, education facilities and convention centres.
  • acted for the project proponent on a $140 million PPP infrastructure project to finance, design, construct, commission and maintain an 85 bed prison hospital and a 135 bed forensic hospital.
  • acted for the Council of the City of Sydney in relation to major civic projects including the Ian Thorpe Aquatic Centre, Customs House upgrade and the Oxford Street upgrade.
  • acted for State government on the redevelopment of regional hospitals throughout New South Wales.
  • acted for State government advising on facilities maintenance projects throughout New South Wales schools. 

Transport 

 
Aviation
  • acted for a major US Aircraft Corporation on the asset purchase of a helicopter servicing and parts distribution business and a helicopter training school.
  • advised a major international airline on negotiation, advice on repair and overhaul agreements for aircraft engines.
  • advised on the acquisition and sale of aircraft and engines, financing and aircraft lease portfolios (including junior and mezzanine finance), structured cross-border financing and international regulatory requirements.

Rail

  • acted on a wide range of projects, including the preparation of tender documentation, rolling stock design and construction. Also advised on maintenance contracts for a major rail manufacturer as well as in respect of contract administration issues arising out of supply, installation and construction agreements.
  • advised on the restructuring of a locomotive construction and maintenance group.

Logistics and projects

  • acted for a tenderer in relation the Public Transport Ticketing Corporations request for a proposal for an electronic ticketing system for Great Sydney. This involved the design, financing, procurement, delivery, operation and maintenance of a new system.
  • acted for an electronic tolling operator in relation to the design, supply, operation and maintenance of electronic tolling system for a major Australian project.
  • provided insurance litigation for two of Australia’s largest logistic groups.
Water
  • acted for a State water authority to draft and assist with negotiations on a number of contract conditions for the design, construction and commissioning of works associated with six water treatment plants delivered through a relationship contract.
  • acted for a State water authority to draft and negotiate amendments to the general conditions of contract for the design, construction and commissioning of works associated with 20 water treatment plants using relationship mechanisms to drive key outcomes.
  • acted for a State water authority to draft and negotiate the general conditions of contract for the designer for a new water treatment plant and to review the invitation document (tender conditions) for appropriateness and consistency.
  • acted for a State water authority to consider the various options with regards to different forms of tenure. These included freehold and those arising under the Land Act 1994 and the applicability of, and viability in relying upon, the access rights given under the South East Queensland Water (Restructuring) Act 2007.
  • acted for a State water authority in relation to the granting of a development lease. This enabled the development and operation of a recreation and tourist park.
  • as the internal legal contact for a State water authority, acted in the acquisition by private treaty of land as part of a compensatory habitat scheme. This included the amalgamation and reconfiguration / subdivision of various properties, the granting of various land use and access rights, obtaining exemptions from the provisions of the Land Sales Act and preparing and negotiating a propagation and translocation program agreement.
  • as the internal legal contact for a State water authority, acted in negotiating water storage easements with land owners for inundation caused in the catchment area of a dam.
