Using evidence from interested 'experts' and working out causation involving increased risks: Sydney South West Area Health Service v Stamoulis [2009] NSWCA 153; BC200906518
In a recent and well-publicised case, the New South Wales Court of Appeal ordered a new hearing on the issue concening breach of duty in a case involving an alleged failure to diagnose earlier breast cancer, where it found that the trial judge had incorrectly excluded important evidence from a reporting radiologist.
