Permanent Impairment
Springhetti and Comcare [2007] AATA 1504 (4 July 2007), Adelaide – SOUTH AUSTRALIA
The Tribunal had to determine whether the applicant suffered permanent impairment in relation to a lower back and psychiatric condition. The applicant first claimed she sustained permanent impairment from a fracture of her sacrum and coccyx in 2001. Liability was accepted but a claim for permanent impairment was rejected in 2006. The second claim was in relation to permanent impairment from reactive depression from 1988 to 1994. Liability had been accepted for this condition but permanent impairment had also been rejected in 2006. On the medical evidence it was clear that the applicant was still suffering the effects of the reactive depression and as such, the Tribunal determined that she suffered permanent impairment to her lower back with the degree of impairment assessed at 10% under table 5.1.
With regards to her lower back condition, it was originally decided that she suffered no impairment under table 9.5. However, the Tribunal determined that she could be assessed under table 9.6, and as such found that she suffered permanent impairment assessed at 10%.
