Our IP&T experts have a wealth of experience in providing advice on freedom to operate, patentability, enforcement and revocation of patent rights, and the damages that flow from these rights. We routinely advise clients engaged in multi-jurisdictional litigation and are experienced in leading or complying with a global team strategy.

The track records of team members include unique experience such as managing complex patent revocation proceedings concerning 22 patents and four designs in one piece of litigation. We also advised on the unprecedented dispute between Fresenius Medical Care and Gambro – the only such case to have been heard by the Federal Court in Australia.


Patent office opposition proceedings: We regularly act for clients in opposing the grant of patents for a variety of pharmaceutical treatments for conditions ranging from cold sores to prostate cancer. We advise on the prospects of success, grounds of opposition and supporting evidence.

Preliminary discovery: We are routinely sought out by clients for advice in relation to preliminary discovery, and are currently assisting an Australian company with devising a strategy to limit the information to be discovered from a broader request by a patent holder.

Anti-counterfeiting: We are acting for Targus, the owner of both standard and innovation patents relating to tablet and laptop covers. We are advising on the implementation of a global strategy to prevent infringing products being imported into, and sold in, Australia.

Enforcement: We are acting for Aker BioMarine, the owner of both standard and innovation patents relating to krill oil and its production, to protect its registered patent rights in Australia. In this matter, we are working with a multi-jurisdictional team to achieve the client’s goals.

Damages quantification after successful patent revocation proceedings: We acted for Fresenius Medical Care in Australia’s watermark matter in relation to damages flowing from a patent case. We continue to advise a variety of clients on the issues critical to these types of proceedings.
