Session 1: Ethics and professional responsibility The ability of an in-house counsel to give legal advice to a business whilst protecting the privilege which attaches to that advice is a key attribute, but it can also raise complex ethical issues. This session will focus on practical tips for identifying the ethical issues which can arise, and resolving those issues in a manner which protects the privilege.
Presenter: Emma Hodgman Emma Hodgman is a Partner of our Financial Services Group andamember ofthe National Financial Services Industry Group. Emma has extensive commercial litigation and dispute resolution experience.She has acted for banks and financial institutions in litigation for the last 15 years.In particular, Emma’s areas of expertise include debt recovery and security enforcement work, as well as advising and defending banks/financial institutions in a wide range of disputes, both in and out of court.

Session 2: Professional skills - Drafting and enforcing “midnight clauses” This session will focus on the drafting skills needed to select the right “midnight clauses” (choice of law, choice of forum, and alternative dispute resolution clauses); and the interpretation and dispute resolution skills necessary to apply the clauses if a dispute arises. This session will also cover the operation of “midnight clauses” in both domestic and international contracts.
Presenter: Mark Addison
Mark Addison is a Partner of our Financial Services Group. Mark’s expertise is in the fields of insolvency and corporate administrations, bankruptcy, debt recovery, and general commercial litigation. He acts for numerous insolvency practitioners on liquidations, administrations and receiverships. Mark has acted for a number of NSW and Commonwealth Government authorities and the Australian Trade Commission in relation to contractual and lease disputes with private parties.

Session 3: Practice management and business skills This session has a strong practical element with case studies and examples relevant to the practice of law. The focus on the rights and obligations of both employees and employers means that this session is equally valuable for both employed solicitors and general counsel with managerial employees. This session will also comprise the mandatory Regulation 176 CLE component on EEO, discrimination and OH&S.
Presenter: Angus Macinnis Angus Macinnis is a Senior Associate in DibbsBarker’s Commercial Group. His practice spans the full spectrum of employment, industrial relations, anti-discrimination and occupational health and safety law. Angus has been presenting seminars that comply with the mandatory CLE requirement since it was first introduced in NSW. Angus also frequently delivers in-house training to line managers and to employees to assist them to recognise and comply with workplace obligations.
