An uninvited knock at your workplace door. What do they want, and how do you respond?
Since the full implementation of the Fair Work Act 2009 (Cth) ("the Act"), employers have been learning to respond to increased levels of intervention in their workplaces. A knock at your workplace door could come from:
- an inspector with the Fair Work Ombudsman, increasingly flexing its investigative muscles; or
- a trade union representative, seeking to exercise right of entry powers, or seeking to initiate bargaining for a collective agreement; or
- a former employee, with a claim for unfair dismissal, or a claim under the new adverse action provisions of the Act.
What these interventions have in common is that each of them, if not correctly managed, carries serious risks for employers.
This seminar will assist you to understand these risks, so that you can be prepared for the knock on the door.

Angus Macinnis will explain the powers of inspectors under the Act and under other relevant legislation. This session will cover the powers and duties of inspectors, the types of information that inspectors are likely to require, and explain how the guide notes which the Fair Work Ombudsman has issued have been operating in practice.
- Maree Skinner will discuss how the unions are approaching right of entry, bargaining issues and the implementation of modern awards. Even if your workplace is currently union-free, this session will assist you to understand how the impact of the unions' approach is likely to ripple out across the workforce as a whole.
- Paul Almond will provide an update on remedies for termination of employment - the old remedies, the new remedies, and the old remedies that have been reworked under the Act. This session will focus on the practical steps required under the Act to manage the risks of termination of employment.
